Here you can learn about how we process your personal data. All types of data and information that can in one way or another be attributed to you constitute personal data. The data we process may have been obtained from you or from others, collected when you visited our website, or obtained in connection with your registration for our events or networks.

1. Data controller

Pharmadanmark is the data controller for the data collected about members, employees, trade trade union representatives, participants in our events, recipients of our newsletters and member magazines, visitors to our website, counterparties, and other parties. We ensure that personal data is processed in accordance with the legislation applicable at any given time.

In situations where Pharmadanmark acts as a data processor, we will, in addition to complying with the law, always be subject to a written data processing agreement describing how we protect personal data.

2. The different types of processing

Below, we explain the purposes for which we process your personal data.

2.1. Your membership

When you are a member of Pharmadanmark, we process ordinary, confidential, and sensitive personal data about you. The purpose of our processing of your personal data is to administer your membership, which includes, among other things, salary, terms and contract negotiations, other advice, various events, organising, offers from our partners, etc. We also collect your personal data in order to be able to report your membership to SKAT.

Pharmadanmark and the Danish Chamber of Pharmacists also cooperate as joint data controllers in producing annual salary statistics for pharmacists employed at pharmacies. In that context, Pharmadanmark is responsible for complying with the General Data Protection Regulation in relation to our members personal data.

Pharmadanmark, the Danish Agency for Governmental Financial Management, and KRL (The Local Government and Regional Government Salary Data Office) also cooperate as joint data controllers in producing annual salary statistics for academically qualified public sector employees. In that context, Pharmadanmark is responsible for complying with the General Data Protection Regulation in relation to our members’ personal data.

We process your personal data based on Article 6(1)(b) and (c) of the General Data Protection Regulation, as the processing is necessary for the performance of the agreement concerning your membership and for compliance with the rules of the Danish Bookkeeping Act. In addition, we process your personal data based on Article 9(2)(d) of the General Data Protection Regulation and section 11(2), no. 4 of the Danish Data Protection Act, as the processing is a necessary part of our legitimate activities as a trade trade union. Furthermore, we process your personal data based on section 12(2) of the Danish Data Protection Act because the processing is necessary in order for us or others to pursue a legitimate interest arising from legislation or collective agreements. We also process your personal data based on Article 9(2)(f) of the General Data Protection Regulation when we provide you with legal assistance, as our processing is necessary for the establishment of a legal claim. Finally, we process your personal data based on your consent, cf. Article 9(2)(a), when we disclose your personal data to our partners.

We may disclose or transfer your personal data to the following categories of recipients: public authorities, for example SKAT, courts, external advisers, for example lawyers, our main organisation, your employer, employers’ associations, other trade trade unions, trade trade union representatives, as well as our partners, suppliers, and data processors.

We store your membership cases for 10 years after each individual case is closed or for 10 years after you have resigned from our trade trade union, should this occur earlier. We delete your basic data at the latter of the following two points in time: 10 years after you have resigned from our trade trade union or at the same time as we delete the last membership case we have concerning you.

2.2. Counterparts and third parties

When we advise our members, we also receive personal data about persons other than our members. Sometimes, following a specific assessment, we determine that we are under a duty of confidentiality, that it is impossible, or that it would require a disproportionate effort for us to notify everyone about our processing of personal data. In such cases, you can always read more here about our processing of personal data. If you have any questions, you can see further down in the policy how to contact us.

We process your personal data based on Article 6(1)(f) of the General Data Protection Regulation. Our legitimate interest is to be a professional organisation that protects the interests of our members. We disclose or transfer your personal data to, among others, the following categories of recipients: public authorities, courts, external advisers, for example lawyers, data processors, and other necessary recipients.

Pharmadanmark has been designated as the organisation entitled to negotiate on behalf of pharmacists employed at pharmacies. In that connection, we receive a copy of the employment contracts for all pharmacists who are to be employed at pharmacies, and we therefore process personal data. We process the personal data based on section 12(1) of the Danish Data Protection Act in order to comply with our employment law obligations and interests as laid down in collective agreements. We store employment contracts relating to members for 10 years after they have resigned from our trade trade union or have left the labour market. For non members where the employment contract complies with the collective agreement, we store the employment contract for up to 6 months.

Employment contracts relating to non members that do not comply with the collective agreement will be stored for up to 10 years in order to establish any legal claims.

2.3. Trade trade union representatives

2.3.1. Our own trade trade union representatives

In order for our trade trade union representatives to represent you as a member with us and provide you with trade trade union assistance, it is necessary for us to exchange personal data with them. Our exchange of personal data takes place in order for us to comply with the private and collective agreements to which we are subject, cf. section 12(2) of the Danish Data Protection Act.

We store your personal data as described in section 2.1 concerning your membership.

2.3.2. Jointly registered trade trade union representatives

In order for our trade trade union representatives to represent members from other trade trade unions, and for you as a member with us to receive trade trade union assistance from trade trade union representatives who are organized elsewhere than with us, it is necessary for us to exchange personal data with other trade trade unions. Our exchange of data takes place in order for us to comply with the private and collective agreements to which we are subject, cf. section 12(2) of the Danish Data Protection Act.

We and the other trade trade unions are each separately the data controller for the processing carried out in connection with the above representation of non members.

If you are a member with us, we store your personal data as described in section 2.1 concerning your membership, while we delete your personal data no later than 10 years after we have closed your case if you are not a member with us, but with one of the other trade trade unions, for reasons related to our professional liability as advisers.

2.4. Legal assistance

When we aid in connection with employment law disputes, we in certain cases disclose ordinary and sensitive personal data to external lawyers. We disclose, among other things, name, email address, trade trade union affiliation, as well as information about the factual circumstances of the case. The purpose of the disclosure is to enable the lawyer to provide assistance in relation to your case.

We process the personal data based on Article 6(1)(a) and Article 9(2)(a) of the General Data Protection Regulation concerning consent. The consent forms part of the mandate agreement.

We store ordinary personal data for 10 years after you have resigned from our trade trade union or at the same time as we delete the last membership case we have concerning you, and based on Article 6(1)(f) of the General Data Protection Regulation concerning legitimate interests. Our legitimate interest is to be able to document the history and course of the case in the event of any claim concerning professional liability as advisers.

We store the sensitive personal data for 10 years after you have resigned from our trade trade union or at the same time as we delete the last membership case we have concerning you based on Article 9(2)(f) of the General Data Protection Regulation, as the storage is necessary for legal claims to be established, exercised, and defended.

2.5. The member magazine Pharma

If you are a member at Pharmadanmark and have chosen to receive the Pharma magazine in physical form, or if you subscribe to receive the Pharma magazine, we will send you the magazine. In order to send you the magazine, we process ordinary personal data about you in the form of your name and your email address.

You can unsubscribe the magazine at any time by contacting pd@pharmadanmark.dk.

For the purpose of distributing the member magazine, we store your personal data for as long as you wish to receive the Pharma magazine from us and for 2 years thereafter. Please note that if you are a member with us, we store your personal data for a longer period as described in section 2.1 concerning your membership.

If you are a member with us, we process your personal data based on Article 6(1)(b) of the General Data Protection Regulation, as our processing is necessary to perform the membership agreement with you.

If you are not a member with us, we process your personal data based on Article 6(1)(a) of the General Data Protection Regulation concerning consent. You may withdraw your consent at any time. Read more about this in section 7 of the privacy policy.

2.6. Events and networks

When you participate in our events and networks, we process the ordinary personal data about you that you have provided to us. This includes your name, title, workplace, address, telephone number, email address, and the type of event or network.

The purpose of our processing of your personal data is to be able to hold events and networks, to keep you informed on an ongoing basis about practical matters concerning our events and networks, and to send you materials, participant lists, etc. When you sign up for one of our courses, events, or networks, we may also contact you for the purpose of inviting you to become a member of Pharmadanmark.

We store your personal data for as long as is necessary to hold and evaluate our events and networks, after which we delete your personal data. We store your personal data for a minimum of five years if the event involves payment, in order to comply with our bookkeeping obligations. Please note that if you are a member with us, we store your personal data for a longer period, as described in section 2.1 concerning your membership.

We process your personal data based on Article 6(1)(b) of the General Data Protection Regulation, as the processing is necessary to perform our agreement with you regarding participation in the event or network, and Article 9(2)(d) of the General Data Protection Regulation, as the processing takes place as part of our legitimate activities as a trade trade union, including the holding of events and networks.

We may disclose or transfer your personal data, except for information about your membership of Pharmadanmark, to our partners, suppliers, and data processors when this is necessary in order for your participation to be carried out.

2.7. Newsletters

You receive our newsletters when you are a member of our trade trade union, or when you have signed up for our newsletters yourself. In that connection, we process ordinary personal data about you in the form of your name, email address, address, and workplace. The purpose of our processing of your personal data is to enable us to deliver our newsletters to you.

For the purpose of distributing newsletters, we store your personal data for as long as you wish to receive newsletters and for 2 years thereafter. Please note that if you are a member with us, we store your personal data for a longer period as described in section 2.1 concerning your membership.

We process your personal data based on Article 6(1)(a) of the General Data Protection Regulation concerning consent or Article 6(1)(f) of the General Data Protection Regulation concerning legitimate interests, when newsletters contain only information about or from Pharmadanmark and our purposes and interests. Our legitimate interest is to be a professional organization that informs our members and stakeholders about news relevant to the sector. We may also process your personal data for the purpose of sending marketing relating to special offers and member benefits and for the use of tracking pixels based on your consent, cf. Article 6(1)(a) and Article 9(2)(a) of the General Data Protection Regulation. You may withdraw your consent at any time by sending an email to pd@pharmadanmark.dk.

We may disclose or transfer your personal data to the following categories of recipients: our partners, suppliers, and data processors.

2.8. The website and MinSide

When you visit our website at https://www.pharmadanmark.dk/ and https://minside.pharmadanmark.dk/en/indmeldelse/, we collect data about you in order to produce statistics, optimise the website, use memory functions, and target marketing. Among other things, we process the following:

  • Your IP address, which is used for statistical purposes and remarketing

  • Your operating system and browser version, which are used to optimize future user experience on the website

  • The date and time of your visit to the website, which are used exclusively for statistical purposes

  • Data is disclosed to third parties such as Google in order to carry out statistics or target remarketing

We process your personal data based on Article 6(1)(f) of the General Data Protection Regulation concerning legitimate interests. Our legitimate interest is to offer you an interesting website that functions optimally. In addition, we process your personal data based on Article 6(1)(a) of the General Data Protection Regulation concerning consent.

We may disclose or transfer your personal data to the following categories of recipients: our analytics partners, partners, suppliers, and data processors.

We post on social media such as LinkedIn and on our website for the purpose of providing information about our purpose and services, showing feedback from members, and describing the benefits and offers available to members of Pharmadanmark. In that connection, we may process ordinary personal data in the posts in the form of name, possibly workplace, name, job title, and images. We process personal data based on Article 6(1)(a) of the General Data Protection Regulation concerning consent or Article 6(1)(b) of the General Data Protection Regulation.

We delete the data on an ongoing basis and no later than 10 years after publication of the content. However, there may be special circumstances that mean we are entitled or obliged to publish the data for a longer period.

2.9. Marketing and recruitment

Pharmadanmark is a trade trade trade union that protects the interests of its members. As a professional association and trade trade union, Pharmadanmark is not subject to the rules and prohibitions of the Danish Marketing Practices Act and the Danish Consumer Contracts Act concerning spam and telephone enquiries when the enquiries concern our political and ideological work, including membership recruitment, etc. This means that when we receive your data in connection with your contact with us, whether as a member, non-member, or otherwise, we may process your data for the purpose of recruiting, re recruiting, or retaining you as a member, just as we may contact you in order to promote the purpose of our organization without your giving separate consent for this. We may contact you by telephone, by email, via social media, or in other ways where we can easily contact you directly using the data we hold about you, just as we may use your data to target campaigns and create tailored communication and offers for you either directly or through third party channels.

In addition, Pharmadanmark may obtain consent to send you marketing material, including information about our partnerships and member benefits. In our ordinary communication, we continuously refer to our member benefits so that members can always find them, but if you have consented to receiving marketing material from us or to our disclosing your personal data to our partners so that they can market themselves directly to you, we may contact you on all the platforms to which you have given consent.

For the purpose of contacting you, we will store your personal data. The storage period depends on the context in which we received your data and can be found in the other sections of this policy.

You may at any time object to being contacted by us and withdraw your consent. We will then store your data only for the purpose of ensuring that we do not contact you again in connection with our marketing and recruitment activities. We will still store your data in other contexts. You can withdraw your consent on MinSide or by sending an email to persondata@pharmadanmark.dk.

We process your personal data based on Article 6(1)(a) of the General Data Protection Regulation concerning consent, or based on Article 6(1)(f) of the General Data Protection Regulation, where the legitimate interest we pursue is to offer you membership, increase your awareness of Pharmadanmark, or otherwise draw attention to our interests and current topics, activities, and benefits that concern you as a member. In addition, we process your personal data based on your consent, cf. Article 6(1)(a) and Article 9(2)(a) of the General Data Protection Regulation, when we disclose your personal data to our partners, and based on Article 6(1)(a) of the General Data Protection Regulation when we call you about or otherwise send marketing based on consent. You may withdraw your consent at any time by contacting us.

2.10. Member benefits 

Members of Pharmadanmark have access to a wide range of member benefits in the form of services and discounts from our benefit partners and other partners. In addition, student members can register directly with Akademikernes A-kasse (unemployment benefit fund) via their membership of Pharmadanmark. Questions concerning membership of AKA must be directed to AKA directly.

At Pharmadanmark, we consider a large part of our member benefits to be a core value of trade trade union membership, where we help you as a member to achieve security and stability in both your working life and your private life. Therefore, you will continuously hear about member benefits in our ordinary communication with you as a member through calls, emails, SMS messages, etc.

To administer the member benefits and ensure that they are always the best possible for all members, we also collect personal data about you, including information about your use of and benefit from the different benefits.

We may also process your personal data in order to market ourselves and our benefit partners and other partners to you, when you have given your consent for us to contact you for marketing purposes. In certain cases, you may also have given consent to our disclosing your personal data to our benefit partners and other partners so that they can market themselves directly to you, including, among other things, your basic data, just as you may have given consent to our exchanging information with the partner so that our partner can verify your membership of Pharmadanmark. You can withdraw your consent yourself on MinSide.

We store your personal data for 10 years from the time you leave the labour market or until 10 years after you have resigned from Pharmadanmark, should this occur earlier. However, this does not apply if you have used your member benefits and you still wish to make use of them. In that case, we can delete your personal data only from the time when your use of the member benefits is no longer conditional upon us having your personal data in our systems, and we as an association no longer have contractual or legal obligations to continue storing your data.

We process your personal data for the purpose of contacting you about your opportunities and benefits as a member of Pharmadanmark based on the balancing of interests rule in Article 6(1)(f) of the General Data Protection Regulation, where the legitimate interest we pursue is our interest in being a professional organisation that informs and updates our members about current topics, activities, and benefits that concern you as a member. In addition, we may process your personal data based on your consent, cf. Article 6(1)(a) and Article 9(2)(a) of the General Data Protection Regulation, when we disclose your personal data to our partners and based on Article 6(1)(a) of the General Data Protection Regulation when we call you about or otherwise send marketing. You may withdraw your consent at any time by sending an email to pd@pharmadanmark.dk.

2.11. Job applicants and employees

Pharmadanmark is serviced by the organization Life Science Danmark ApS and therefore, as a rule, has only a limited number of employees. If you choose to apply for a job with Pharmadanmark, we disclose your application to the organisation Life Science Danmark ApS, and all processing carried out by Life Science Danmark ApS takes place exactly as described here for Pharmadanmark in this privacy policy.

If you apply for a job at Pharmadanmark or Life Science Danmark, we process the personal data you provide in your application as well as personal data we receive from third parties whom you have authorised us to contact. We store all applications for a period of up to three years so that we can ensure that we find the right candidate for the position. We process your personal data based on your consent and our legitimate interest in assessing your application and documenting the recruitment process, cf. Article 6(1)(a) and (f) of the General Data Protection Regulation.

When you are employed by one of us, we process ordinary personal data about you in the form of name, address, email address, telephone details, contact details, salary details, bank and account details, etc. In addition, we process confidential data about you in the form of your CPR number and possibly relevant information concerning criminal offences. Finally, we process sensitive personal data about you in the form of any health data or other relevant information that you provide to us as part of your employment.

We process your ordinary and confidential personal data based on Article 6(1)(b) of the General Data Protection Regulation because our processing is necessary to perform the employment contract with you, and Article 6(1)(f) concerning legitimate interests. Our legitimate interest is to be able to communicate with you about work-related matters and to be able to provide you with information. We process your CPR number based on section 11(2), no. 1 of the Danish Data Protection Act because we are obliged to provide SKAT with several details about you, including your CPR number.

We process your sensitive personal data based on Article 9(2)(f) of the General Data Protection Regulation because our processing of your health data is necessary in order for a legal claim relating to, for example, an occupational injury or other work-related matter to be established, exercised, and defended.

When you are no longer employed by one of us, we generally store your personal data for a period of 10 years after termination of employment. However, there may be special circumstances that mean we are obliged to store it for a longer period.

2.12. Applications to the funds that we administer

When we receive applications for grants from the funds that we administer, we process ordinary personal data about the applicants in the form of, among other things, name, email address, position, telephone number, education, address, and signature. We also process sensitive personal data in the form of the applicants’ trade trade union affiliation. In addition, we process personal identification numbers and bank and account details relating to those applicants who are awarded funds.

We process ordinary personal data on tbased onicle 6(1)(f) of the General Data Protection Regulation concerning legitimate interests. Our legitimate interest is to provide the agreed assistance to the funds, including assessing the applications and administering the payment of grants.

We process and store sensitive personal data in the form of the applicants’ trade trade union affiliation based on Article 9(2)(a) of the General Data Protection Regulation concerning consent.

We process and store personal identification numbers based on section 11(2), no. 1 of the Danish Data Protection Act, as we have a legal obligation to report the payments to SKAT and under the rules of the Danish Bookkeeping Act.

As regards applications to Klavs Steens Andersens Fond, we also process sensitive personal data in the form of health data. We process and store the health data based on Article 9(2)(a) of the General Data Protection Regulation concerning consent.

We store applications to the funds based on Article 6(1)(f) of the General Data Protection Regulation concerning legitimate interests. Our legitimate interest is to know who has previously received grants, to observe any waiting periods, and to be able to pay grants that are to be paid later.

Personal data in accounting material is stored for five years based on Article 6(1)(c) of the General Data Protection Regulation, as we have a legal obligation to report payments to SKAT and to store accounting material under the rules of the Danish Bookkeeping Act.

Applications to Klavs Steen Andersens Fond are stored until all grants for the relevant application period have been paid out. The names of, and application dates for, the applicants who are awarded grants from the fund are deleted after 5 years.

Applications to the Education and Development Fund that result in grants being awarded are stored for 3 years. The other applications are deleted when all grants for the relevant application period have been paid out.

Applications to the Study Fund are stored until all grants for the relevant application period have been paid out. The names of, and application dates for, the applicants who are awarded grants from the fund are stored for 2 years.

Applications to the Education Fund for Pharmadanmark, Regions and Municipalities are deleted when all grants for the relevant application period have been paid out.

2.13. The European Journal of Hospital Pharmacy magazine

When you are a member of Pharmadanmark’s Regions and Municipalities section, you receive the magazine The European Journal of Hospital Pharmacy from the association The European Association of Hospital Pharmacists. For you to receive the magazine, we disclose your name, your address, and your contact details to The European Association of Hospital Pharmacists, which will then send the magazine to you from then on.

We process your personal data based on Article 6(1)(b) of the General Data Protection Regulation, as our processing is necessary for us to fulfil our agreement with you concerning your membership with us.

You may contact us at persondata@pharmadanmark.dk at any time or update your data on MinSide at www.pharmadanmark.dk if you no longer wish to receive the magazine.

We store the personal data until you either no longer wish to receive the magazine or resign from our trade trade union.

3. How

In order to be able to offer you membership, our member magazine, newsletters, events, networks, services, a good website, jobs, etc., it is necessary for us to process your personal data by collecting, recording, organising, storing, using, retaining, deleting, transferring, and disclosing your data.

4. Recipients or categories of recipients

We may, among other things, disclose or transfer your personal data to employers, jointly registered trade trade union representatives, our data processors, advisers, for example lawyers, other external suppliers or partners, as well as public authorities, including SKAT and the courts.

5. Transfer of your personal data to third countries

In certain cases, we transfer your personal data to recipients in third countries. This takes place when we use data processors outside the EU or the EEA. The legal basis for the transfer is the European Commission’s standard contractual clauses or other necessary safeguards under Article 46 of the General Data Protection Regulation if the European Commission has not adopted an adequacy decision regarding the level of protection in the third country. You can contact persondata@pharmadanmark.dk if you would like information about how to obtain a copy of the relevant transfer basis or where the relevant transfer basis has been made available.

6. Security

We ensure that the data you give us, or that we receive about you, is stored securely and confidentially. From a technical perspective, we always ensure that we use data processors whom we have made sure provide the same level of security around your data as we do, and internally and organizationally we focus on educating and training one another to ensure a high level of data security. Where appropriate, we ensure that your personal data is encrypted, pseudonymized, or anonymized. We will always ensure that we comply with the applicable personal data legislation.

We have implemented appropriate technical and organizational measures against your personal data being accidentally or unlawfully deleted, disclosed, lost, degraded, accessed by unauthorized persons, misused, or otherwise processed in breach of the legislation applicable at any given time.

We use various encryption solutions to address the risk associated with sending sensitive and confidential personal data by email to members, other trade trade unions, etc.

We delete your personal data when we no longer need to process it to fulfil one or more of the purposes mentioned above. There may, however, be special rules in legislation, for example in the Danish Bookkeeping Act and the Danish Limitation Act, that give us the right and obligation to store it for a longer period.

7. The right to withdraw your consent

You have the right at any time to withdraw your consent from us processing your personal data. You can do so by sending an email to persondata@pharmadanmark.dk.

If you choose to withdraw your consent, this will not affect the lawfulness of our processing of your personal data based on your previously given consent and up to the time of your withdrawal. If you withdraw your consent, the withdrawal will only take effect from the time of withdrawal.

Please remember that if you withdraw your consent to us sending you one of our newsletters, we can no longer send you that particular newsletter.

8. Your rights

You have several rights in relation to our processing of your personal data:

  • The right to erasure

  • The right to restriction of processing

  • The right to object

  • The right to data portability
