When losing your job threatens your permit to stay in Denmark

Did you move to Denmark for work – and are now at risk of losing your job? If your legal residency in Denmark depends on your job, losing your job is an issue you are legally obligated to handle in order to stay in Denmark. The current situation in the Danish Life Science industry can cause a lot of uncertainty. This guide will hopefully answer most of your questions. 
Layoff

If your employment is terminated

The consequences for your work and residence permits have presumably been listed in the letter you received from SIRI (the Danish Agency for International Recruitment and Integration), when you were last granted a work and residence permit. It is, therefore, our recommendation that you review your latest work and residence permit and contact SIRI immediately, who will assist you with clarifying your right to stay and work in Denmark.

The authorities are obliged to inform and guide you on the matters above, and you can request a written copy of any guidance you might receive.

Your employer will presumably inform SIRI about the termination of your employment, but it is your legal responsibility to ensure your right to stay in Denmark.

Depending on your latest work and residence permits, you can apply for a job seeking permit. It is our recommendation that you do not volunteer for redundancy at your current employer as your right to a job seeking permit may require that you have not been voluntarily redundant.

Staying in Denmark while seeking a job

If you receive a job seeking permit (see above), you are entitled to stay in Denmark under the requirements listed in your job seeking permit. During this period, you must actively search and apply for other jobs, and it is, therefore, our recommendation that you save any documentation in connection hereto, including the actual applications and any receipts/emails concerning each application.

New job

When you secure a new job, remember to apply for a new work, and residence permit. You cannot commence a new position without a new working permit, unless otherwise stated in your latest work and residence permit or your job seeking permit. Residency

If you cannot secure a new job within the job seeking period subject to the job seeking permit, you must apply for another type of residency (e.g., student permit, family reunification, etc.) with SIRI or leave Denmark before your current permit expires.
